The party operator’s guide to contracts and protecting yourself
- Can I use a contract template I found online? →As a starting point, not a finish line. Templates miss the clauses this business actually needs: weather, site access, water and power, and supervision. Pay a local attorney once to make it yours.
- Do I need a liability waiver for a foam party? →Yes, signed by the host before the event, with participants covered through posted rules and the host's acknowledgment. A waiver sets expectations and helps your insurer help you.
- What happens if a kid gets hurt at my event? →Your response in the first ten minutes matters more than anything in the contract. Care for the child, document, notify your insurer the same day, and never negotiate directly.
- What insurance does a mobile party business need? →General liability first, one million per occurrence as the common floor, because venues and schools ask for a certificate before they ask anything else. Commercial auto if a truck or trailer is involved.
- What should a party rental contract include? →Nine things: the parties, the date and window, the price and payment schedule, deposit terms, cancellation and weather policy, site requirements, liability language, damage terms, and the signature.
- Are electronic signatures legally binding? →Yes. The federal ESIGN Act and state UETA laws have made electronic signatures binding in the US since 2000, when the signer shows intent and consents to sign electronically.
